Terms of Service

Agreement

These Terms of Service apply to services provided by Nexus Digital Solution Sdn Bhd. By engaging us, approving a proposal, issuing a purchase order, signing a service agreement, or allowing us to perform work, you agree to the applicable service scope and these terms unless a separate written agreement states otherwise.

Services

Our services may include cloud management, cloud operations, cybersecurity, CNAPP, DDoS protection, WAF protection, CDN services, bot management, penetration testing, vulnerability scanning, endpoint protection, database management, database security, AI model integration, monitoring, support, consulting, and related technology operations.

Service Scope

Each engagement should define scope, deliverables, assumptions, timelines, support hours, access requirements, fees, and responsibilities. Any work outside the agreed scope may require a separate quotation, change request, or written approval.

Customer Responsibilities

  • Provide accurate information, required approvals, and timely access to relevant systems.
  • Maintain ownership of business decisions, data, cloud accounts, subscriptions, applications, and third-party services.
  • Ensure that requested security testing, scanning, monitoring, or remediation work is authorized.
  • Review and approve changes before production implementation where approval is required.

Security Testing

Penetration testing, vulnerability scanning, and security assessments must be performed only on systems that the customer owns or is authorized to test. Testing windows, targets, methods, exclusions, and reporting requirements should be agreed before work begins.

AI Services

AI integrations may connect to third-party model providers such as Anthropic, OpenAI, Gemini, DeepSeek, MiniMax, Seedance, or other AI platforms. Model outputs may be probabilistic and should be reviewed by the customer before business-critical use. Third-party provider terms, pricing, data handling, and availability may apply.

Fees and Payment

Fees, billing cycles, payment terms, taxes, third-party costs, and usage-based charges should be stated in the relevant quotation, invoice, or agreement. Late payment may result in suspension of non-critical services after reasonable notice.

Limitations

We aim to provide professional and reliable services, but no technology service can guarantee uninterrupted availability, complete security, zero vulnerabilities, or perfect protection against every threat. Liability is limited to the extent permitted by applicable law and any written agreement between the parties.

Termination

Either party may terminate services according to the agreed contract, proposal, or written notice terms. Upon termination, outstanding fees remain payable and customer access or data handover should be handled according to agreed procedures.
